1. Our approach
We respect the rights of copyright owners and expect everyone who uses ClipCheap to do the same. OurTerms of Service require users to own, or have permission for, every video they process and every clip they publish.
If you believe content on ClipCheap infringes your copyright, send us a notice as this policy describes. We handle notices in line with the provisions for network service providers in Singapore’s Copyright Act 2021 and its regulations, and we also accept notices that follow the US Digital Millennium Copyright Act (DMCA). This policy is part of our Terms of Service.
2. Before you send a notice
- Check where the content is. Videos and clips in ClipCheap are private to the workspace that made them. Public copies are usually on the apps they were posted to, such as YouTube, TikTok or Instagram, so to remove a published post, send your notice to that app. Send it to us when the content is stored in ClipCheap or shared through a link we created.
- Check whether the use is allowed. Some uses don’t need permission, such as fair use or uses covered by a license. Consider whether that applies before you send a notice.
- Check that the right is yours to enforce. Only the copyright owner, an exclusive licensee, or someone authorized to act for them can send a notice.
3. How to send a takedown notice
Email your notice to copyright@clipcheap.app, or send it by post to the address inContact. Write it in English and include:
- your full name, postal address, phone number and email address;
- the copyright work you say is infringed, or, for several works, a representative list of them;
- the material you say is infringing, with enough detail for us to find it, such as a link to it;
- a statement that you are the copyright owner or an exclusive licensee, or are authorized to act for them;
- a statement that you believe in good faith that the use of the material isn’t authorized by the copyright owner, its agent or the law;
- a statement that the information in your notice is accurate and, under penalty of perjury, that you are authorized to act for the owner of the right you say is infringed; and
- your physical or electronic signature.
If a notice is incomplete or unclear, we may ask you for more information, and we may not be able to act on it until we have it.
4. What happens after a notice
- We review every notice. When a notice is complete and valid, we promptly remove the material or disable access to it.
- We tell the user responsible and send them a copy of your notice, including your name and contact details, so that they can respond to you or to us.
- We keep a record of each notice and may share it with courts or authorities when the law requires it.
5. Counter-notices
If your content was removed and you believe that was a mistake, because the material was misidentified or because you have the right to use it, you can send a counter-notice to copyright@clipcheap.app. Include:
- your full name, postal address, phone number and email address;
- the material that was removed, and where it was before it was removed;
- a statement, under penalty of perjury, that you believe in good faith that the material was removed or disabled because of a mistake or misidentification;
- a statement that you consent to the jurisdiction of the courts of Singapore and, for a counter-notice under the DMCA, of the US federal district court for the district where your address is (or, if your address is outside the United States, any judicial district in which we may be found), and that you will accept service of legal process from the person who sent the original notice or their agent; and
- your physical or electronic signature.
We send a copy of your counter-notice, including your contact details, to the person who sent the original notice. Unless they tell us that they have started court proceedings to stop the alleged infringement, we may restore the material 10 to 14 business days after we receive your counter-notice.
6. Repeat infringers
We close, in appropriate circumstances, the accounts of users who repeatedly infringe copyright. Each valid notice counts as a strike against the account and workspace concerned. As a guide, an account or workspace with three strikes in 12 months is closed, and we may close one sooner for serious or obvious infringement. A strike is removed if a counter-notice succeeds or the notice is withdrawn.
7. False or misleading notices
Send a notice or counter-notice only if you are confident of your position. Knowingly making a false or misleading statement in one can be an offense, and can make you liable for damages, including the costs of the person affected and ours. We may disregard notices that are clearly abusive.
8. Other complaints
This process is for copyright only. For trademark, privacy or other legal complaints, write tolegal@clipcheap.app. To report content that breaks our rules in other ways, see ourAcceptable Use Policy.
